HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.37948 OF 2017 O R D E R :
The petitioner claims to be the owner of Ashok Leyland Trolley bearing No.TS 28 T 0379. While the said vehicle was transporting rice on 05.07.2017 it was intercepted by the fourth respondent and alleging that it was PDS rice, the vehicle was seized and a crime was registered. The petitioner submitted an application on 11.09.2017 before the 2nd respondent for release of the vehicle. When no orders are passed on his application, the petitioner filed the present writ petition seeking a direction to the 2nd respondent to release the vehicle.
Since the petition filed by the petitioner seeking release of the vehicle is pending before the 2nd respondent, this writ petition is disposed of directing the 2nd respondent to release the vehicle on condition of the petitioner furnishing appropriate bank guarantee/ third party security, for the value fixed by the 2nd respondent and imposing usual conditions relating to vehicle for the purpose of enquiry now pending.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
