THE HON'BLE SRI JUSTI CE A.V.SESHA SAI WRI T PETI TI ON NO.39262 OF 2018 ORDER:

When the matter is taken up, the written instructions dated 3.12.2018 furnished by the Station House Officer, Dandepally P.S., Mancherial district are placed before this Court by the learned Government Pleader. The said written instructions read as under:

"It is submitted that in the petition, it is stated that on 16.3.2018 night at 08.00 hours, filed a petition in the Police Station and case registered against Billakuri Mallesh and Mayamooda Begham on 17.3.2018 by Dandepalli Police Station, but still did not call them. Therefore, on 21.4.2018 Billakuri Mallesh and Mayamooda Begham were attacked on him by saying, they are benamis to the Nayeem. Later, her an away from there and called to 100. Later Dandepalli police came there and S.I. called him. Then he went there and found 20 youth were gathered with the S.I. later, he took his motor cycle, which was left by him. Later, the S.I. told him to bring his land records. Then, he showed his land record. But the S.I. told him to wait for Monday so that the MRO came to the place of offence. His lands are situated at 4 KMs from the village and the said persons are having weapons. Hence requested to take necessary action.

It is submitted that, on 21.4.2018 afternoon, the S.I. of Police, Dandepalli PS received a 100 call from

DG Control from 9989599398, which belongs to Muddasani Bheemaiah, R/o. Korivichelama. After receiving call, the S.I. of Police went there and found there is no one at the scene of offence. After 20 minutes, Muddasani Bheemaiah, his son and Billakuri Mallesh and their villagers around 6 persons came. They argued about the same land. Later, the S.I. of Police told them that in this regard, Crime No. 40/2018 u/s 447, 427 IPC, dated 17.3.2018 was registered and still the case is under investigation and disbursed them from the scene. It is submitted that, in this case, the revenue report is pending, hence the case is pending for investigation. It is submitted that, after receipt of revenue report, the investigation will be completed and appropriate report will be filed before the concerned Court.

It is submitted that, after enquiry, a notice was also given to the 2nd petitioner/complainant under acknowledgement. In spite of the same, the present writ petition has been field alleging that the Police have not taken any action on the petition dated 22.4.2018. It is submitted that, as stated above, action has already been taken on the petitioner's petition and after enquiry, the 2nd petitioner was also given a notice under acknowledgment."

Having regard to the contents of the above instructions, this Court deems it appropriate to dispose of the Writ Petition by placing the above instructions on record.

The Writ Petition is accordingly, disposed of.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
