THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.35952 of 2017 ORDER:

The petitioner claims to be the owner of an auto bearing No.TS 04 UB 0517. While the said vehicle was transporting rice on 24.07.2017 it was intercepted by the fourth respondent and alleging that it was PDS rice, the vehicle was seized and a crime was registered. The petitioner submitted an application on 11.09.2017 before the second respondent for release of the vehicle. When no orders are passed on his application, the petitioner filed the present Writ Petition seeking a direction to the second respondent to release the vehicle. Since the petition filed by the petitioner seeking release of the vehicle is pending before the second respondent, this Writ Petition is disposed of directing the second respondent to release the vehicle on condition of the petitioner furnishing appropriate bank guarantee for the value fixed by the second respondent and imposing usual conditions relating to vehicle for the purpose of enquiry now pending.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 27.10.2017 vs
