THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.14838 of 2016 ORDER: (Per the Hon'ble Sri Justice Ramesh Ranganathan) Sri S.Srinivas, learned counsel for the petitioner, has placed before this Court a copy of the order passed by the Supreme Court in I.A.No.2 of 2016 in S.L.P(Civil).No.6122 of 2016 dated 05.07.2016 clarifying that the balance 75% of the tax is not required to be deposited. Learned counsel would submit that, since the order of the Supreme Court in S.L.P (Civil). No.6122 of 2016 dated 05.07.2016 requires this Court to consider the writ petition, the petitioner would file an application in W.P.No.3027 of 2016 seeking restoration of the said writ petition; and it would suffice if this Court were to grant the petitioner liberty to do so, set aside the proceedings dated 24.04.2016, and close the present writ petition.

Sri T.Vinod Kumar, learned Special Standing Counsel for Commercial Taxes, would fairly state that such an order could be passed.

Granting liberty to the petitioner to file an application seeking restoration of W.P.No.3027 of 2016, the proceedings dated 24.04.2016 is set aside and this writ petition is disposed of accordingly. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
