The case of the petitioners is that the 1st petitioner is doing petty rice business in Seetharampuram, Miryalaguda village and Mandal, Nalgonda District and the 2nd petitioner is the owner of Ashok Leyland Lorry bearing Registration No.TS 05UC 1129 and while transporting the rice of 319 bags each 50 kg bag worth of Rs.1,60,000/- in the said lorry he was arrested on 25-09-2017 along with lorry on the ground of violations of provisions of Essential Commodities Act (for short "the Act"). On that the 1st petitioner filed a representation on 12-10-2017 to the 2nd respondent to release the seized stock and the 2nd petitioner also filed a representation on 12-10-2017 to release the above said lorry. But the said representations are not being disposed of, aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioners submits that since the proceedings under Section 6-A of Act are pending, no useful purpose would be served in keeping the vehicle and seized stock with the respondent-authorities. Heard learned Government Pleader for Civil Supplies.

also to release the seized lorry in favour of the 2nd petitioner on furnishing bank guarantee and documents regarding ownership of the vehicle.
