This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioners, who are A2 to A5, in Cr.No.105 of 2018 on the file of the Station House Officer, Rajapur Police Station, Mahabubnagar District.

The offences alleged are under Sections 420, 464, 466, 468, 470, 471, 472, 473 read with Section 34 of the Indian Penal Code. 2.

Heard the counsel for the petitioners and the learned Public Prosecutor appearing for the respondent.

The allegations against the petitioners that they, being brothers, have created fabricated documents by using the fake rubber stamp of Tahsildar, Balanagar.

The complaint shows that the revenue authorities have thoroughly verified the concerned revenue records pertaining to the above fabricated documents and have issued endorsements to the complainant stating that the said documents are not issued by them from their office and the file number shows that the said documents pertain to income certificates issued from their office to others.

The counsel for the petitioners now submits that A1 was granted bail by this Court.

But the bail was granted to A1 taking into consideration that she was a sexagenarian. The said benefit cannot be extended to the petitioners herein, as the allegations are there against all the

petitioners together. Hence, this Court does not find it a fit case to grant bail to the petitioners.

Hence, the criminal petition is dismissed. However, considering the request of the petitioners, the Court below is directed to dispose of the bail petition that would be filed by the petitioners, preferably, on the same day subject to pressure of other work.
