Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner was appointed as Fair Price Shop Dealer of Shop No.15 of Melacheruvu Village and Mandal, Suryapet District. It appears that the Sub-Inspector of Police, Mellacheruvu Police Station intercepted one lorry bearing registration No. AP 24 TA 6678 on 27.09.2017 at about 3.00 am., at Mellacheruvu Village and Mandal and seized the available rice of 240 bags along with the lorry on the allegation that the driver of the lorry was diverting the PDS rice from Mellacheruvu village to other places illegally without any permit and way bill. A case in Crime No.326 of 2017 was registered on 27.09.2017 against the petitioner and others. Though the authorization of the petitioner is subsisting, the essential commodities were not supplied to the petitioner. Hence, the present writ petition is filed. The writ petition was adjourned on 13.10.
2017 in order to enable the Government Pleader to get instructions. Even after two adjournments, the learned Government Pleader did not get any instructions. In the circumstances, the writ petition is disposed of directing the respondents to supply the essential commodities to the petitioner for distribution to the card holders so long as the authorization of the petitioner is valid and subsisting.
The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO, J October 23, 2017 KTL
