THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.41892 OF 2015

O R D E R

The prayer in this case is as under:

"For the reasons stated in the accompanying affidavit the petitioner prays that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 3 and 4 in repeatedly insisting the petitioner to surrender the land to the 5th respondent, which is purchased by his under registered sale deed dated 08-07-2013 otherwise implicate the petitioner in the false cases, is illegal, irregular, arbitrary and without jurisdiction, violative of principles of natural justice and offend Articles 14, 21 and 300-A of Constitution of India and consequently direct the respondents 3 and 4 to take appropriate necessary action against the illegal demands made by the 5th respondent and not to interfere in any manner with civil dispute of the petitioner between the 5th respondent and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Written instructions dated 05.01.2016 were furnished by the SubInspector of Police, Ongole II Town Police Station, Prakasam District, to the office of the learned Government Pleader for Home wherein he stated that no cases have been registered against the petitioner on the file of the Ongole II Town Police Station and therefore, the question of interfering with his life and liberty did not arise. The Sub-Inspector of Police denied the allegation that the petitioner was being pressurized by the police authorities to surrender a piece of land to the fifth respondent under threat of being implicated in false cases.

The aforestated stand of the police authorities is taken on record. In the light thereof, no adjudication is called for in this writ petition and the same is also fairly conceded by Sri Naga Praveen Vankayalapati, learned counsel for the petitioner.

The Writ Petition is accordingly closed. Pending miscellaneous

petitions shall stand closed in the light of this final order. No order as to costs.
