THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17432 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner's wife was appointed as permanent Fair Price Shop Dealer of Shop No.9 of Kapupalli Village, Puthalapattu Mandal, Chittoor District, in the year 2010. The authorization of the dealer was renewed up to 31.03.2016. But unfortunately she died on 26.05.2015 leaving the petitioner and two minor children. The petitioner submitted an application for appointment on compassionate grounds, as he was unemployed. The District Supply Officer forwarded the application to the 2nd respondent. The petitioner submitted another application to the 2nd respondent, on which, the 2nd respondent made an endorsement to the 3rd respondent to examine and take necessary action, by his endorsement dated 11.06.2015. The present writ petition is filed for consideration of the case of the petitioner for appointment on compassionate grounds in the vacancy caused by the death of his wife on 26.05.2015.

The learned counsel for the petitioner submits that if there is delay in consideration of the application of the petitioner for appointment on compassionate grounds, a temporary dealer would be appointed and the interest of the petitioner would be prejudiced. In the circumstances, the writ petition is disposed of, directing the respondents 2 and 3 to consider the case of the petitioner for appointment on compassionate grounds, in terms of G.O.Ms.No.4 dated 28.02.2014, if the petitioner is eligible for the same, and dispose of the application of the petitioner within a period of three months from the date of receipt of a copy of the order.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
