O R D E R
This writ petition has been filed challenging the proceedings of the 2nd respondent - District Collector in Case No.CS6/210/2017-2 dated 3.11.2017, whereunder the said authority passed orders for interim disposal of the stocks seized from the rice mill of the petitioner under Section 6-A(2) of the Essential Commodities Act, 1955 (for short 'the Act').
The learned Assistant Government Pleader for Civil Supplies seeks time for filing counter affidavit.
The learned counsel for the petitioner submits that the writ petition may be disposed of directing the 2nd respondent to complete the enquiry under Section 6-A of the Act within certain time limit. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent - District Collector, to complete the enquiry under Section 6-A of the Act, after giving notice to the petitioner and considering the objections raised by him with regard to the seized stocks, within a period of three months from the date of receipt of a copy of this order. Till then, the seized stocks shall not be sold.
No order as to costs.
