This writ petition is filed for a writ of Mandamus declaring the action of the 2nd respondent in not releasing the petitioner's Ashok Leyland Lorry bearing registration No.TS 05 UC 3959, worth Rs.3 lakhs in her favour on furnishing Bank Guarantee as per petitioner's representation dated 17.10.2017, as illegal and arbitrary and for a consequential direction to the respondent No.2 to release the said vehicle. The case of the petitioner is that she is the owner of Lorry bearing registration No.TS 05 UC 3959 and doing transport business on hire basis. While so, on 17.07.2012, the police officials of Miryalaguda Rural Police Station intercepted the petitioner's lorry and seized the petitioner's vehicle on the ground that the rice found in the lorry pertains to PDS. Thereafter, the petitioner submitted application dated 17.10.2017 to the 2nd respondent for release of his vehicle. As no orders are passed, present writ petition is filed.

Heard both sides.

Having regard to the facts and circumstances, the 2nd respondent is directed to consider the application of the petitioner for release of the vehicle on Bank Guarantee being furnished by the petitioner, within a period of two weeks from the date of receipt of a copy of this order. With the above directions, writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
