HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.21380 of 2016 ORDER:

The grievance of the petitioner is that Notice dated 24.06.2016 has been issued to the petitioner alleging that she has constructed a compound wall in the Gram Panchayat Poramboke. When the petitioner sought to submit her explanation, the 3rd respondent-Gram Panchayat has refused to receive the same and the respondent authorities went upon damaging the compound wall constructed by the petitioner in the year 2000.

Sri Ravi Cheemalapati, learned Standing Counsel for Gram Panchayat fairly submits that since the petitioner has come up before this Court specifically stating that 3rd respondent has been refusing to receive the explanation submitted by the petitioner, interest of justice would be served if a direction is issued to the 3rd respondent to receive the explanation submitted by the petitioner and after considering the same in accordance with law necessary orders may be passed. Considering the submissions made by the learned standing counsel for the Gram Panchayat, the petitioner shall be at liberty to send the explanation through registered post with acknowledgment due to the 3rd respondent and till such time, the 3rd respondent considers the explanation that is submitted and further explanation that he desires to submit along with the documents, are considered and necessary orders are passed, there shall not be any interference with the construction made by the petitioner.

Subject to the above, the writ petition is disposed of. There shall no order as to costs. Consequently, miscellaneous petitions pending, if any, shall also stand closed.
