The case of the petitioners is that their father by name late Yama Reddy was the protected tenant of agricultural land admeasuring Ac.6-20 guntas in sy.No.155 of Nidgurthy Village, Utkoor Mandal, Mahabubnagar District and one Narsingaiah was the pattadar to the said land. That said Narsingaiah is having more than two family holding and therefore, the protected tenants are entitled to be given ownership certificate under Section 38-E of Andhra Pradesh (Telangana Area) Tenancy and Agricultural Lands Act, 1950. After death of their father, the petitioners succeeded the subject land and as they are in possession and enjoyment of the same made an application dated 14-09-2017 to the 2nd respondent and after assigning the case No.B/369/2018 to the said application, the 2nd respondent called for the report from the 3rd respondent and accordingly the 3rd respondent has also submitted report in favour of the petitioners. As the application is not being disposed of, the present writ petition is filed.
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.
In view of the facts and circumstances of the case, the 2nd respondent is directed to consider the application of the petitioners dated 14-09-2017 by taking into account the
report submitted by the 3rd respondent and pass orders, in accordance with law, within a period of four months from the date of receipt of a copy of this order.
