HON'BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION No.4518 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies-Respondents 1 to 4.

This writ petition is filed seeking writ of Mandamus declaring the impugned proceedings of the 2nd respondent passed in Rc.No.4401/14L dated 15.10.2014 initiating the enquiry on the flimsy allegations against the petitioner Shop No.19, Narnepadu Village, Muppalla Mandal, Guntur District, as illegal and arbitrary and for a consequential direction to set aside the same.

3. It is the case of the petitioner that he was appointed as a permanent FP shop dealer of Shop No.19, Narnepadu Village, Muppalla Mandal, Guntur District, about 24 years back. While so, the 4th respondent along with his staff inspected the shop on 05.10.2014, verified the registers and found that there was variation in the stock. Thereafter, a show cause notice was issued on 11.10.2014 alleging certain irregularities against the petitioner and on the same day, the authorisation of the petitioner was also suspended. The petitioner submitted his explanation on 01.11.2014. The grievance of the petitioner is that the suspension order is passed without any valid reasons.

4. In view of the judgment of the Division Bench in WAMP No.343 of 2015 in WA No.118 of 2015, this Court is not inclined to examine the suspension order at this stage. Though, the suspension order was passed on 11.10.2014, so far no enquiry has been conducted. The 2nd respondent-Revenue Divisional Officer, Guntur, is under a duty to conduct enquiry and pass final orders within 90 days from the date of the order of suspension.

5. In the aforesaid circumstances, the 2nd respondent-Revenue Divisional Officer, Guntur, is directed to conduct enquiry and pass appropriate final orders, within a period of two weeks from the date of receipt of a copy of this order, failing which the suspension shall stand revoked.

6. The writ petition is accordingly disposed of. No order as to costs. Pending miscellaneous petitions, if any, in this writ petition shall stand dismissed in consequence.
