HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.38329 of 2017 ORDER:

Heard Sri Sanjeev Gillella for petitioner and the Assistant Government Pleader for Medical and Health.

The writ prayer reads as follows :- " ..... to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the respondent No.3 in settling the outsourcing bills for the period from September, 2016 to September, 2017 as arbitrary, illegal, colourable exercise of power and contrary to the well established legal principles, apart from being violative of fundamental rights guaranteed to the petitioner under Articles, 14, 19 and 21 of the Constitution of India and consequently direct the respondent No.3 to clear the bills submitted by the petitioner from the months September, 2016 to September, 2017....." . It is one thing if the petitioner by filing writ petition prays for recovery of Rs.5,53,75,788/ -, but the grievance of petitioner, which appears to be genuine is that respondents 2 and 3 are not taking up representation given by the petitioner on 09.09.2017 either paying the amount or giving a reply.

The Assistant Government Pleader submits that the representation can be directed to be disposed of by respondents 1 to 3 within reasonable time.

I am satisfied the writ petition can be disposed of by this order.

a) The petitioner is given liberty to re-submit representation dated 09.09.2017 to respondents 1 to 3 by enclosing a copy of this order within two weeks from today.

b) Respondents to consider the representation and proceed to do as warranted in the facts and circumstances of the case.

c) The petitioner, if receives a reply, is given liberty to work out remedies by filing a suit in accordance with law.

The writ petition is disposed of accordingly. No order as to costs.
