The prayer in the writ petition is that the petitioner is seeking retrospective promotion with effect from 05-09-2008 stating that the respondents 3 and 4 are his juniors. But the petitioner has not challenged the promotions of respondents 3 and 4, obviously she cannot do at this length of time. Learned counsel for the petitioner however states that at least the case of the petitioner may be considered for promotion for future vacancies, since respondents 3 and 4 though juniors to petitioners are promoted in the year 2008. Since the petitioner has not challenged the promotions of respondents 3 and 4, the writ petition is liable to be dismissed. Obviously, the petitioner without challenging the promotions of the respondents 3 and 4 cannot be given promotion from 05-09-2008. As such, the writ petition is misconceived. The petitioner can seek for promotion in future vacancies, if he is eligible, qualified and comes within zone of consideration.

If the respondents have taken any decision for promotions, they are directed to consider the case of the petitioner for promotion to the next category in accordance with rules.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 25-10-2017 Nvl
