THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.12569 of 2016 ORDER:

The petitioner, who is A.4 in crime No.238 of 2015 of Mahaboobnagar Rural Police Station, preferred the present application under Section 438 Cr.P.C. seeking release in the event of her arrest in connection with the above crime registered for the offence punishable under Sections 454 and 380 of Indian Penal Code.

The material collected by the investigating agency during the course of investigation reveals that A.1 to A.4 were habituated to bad vices and for leading luxurious life decided to commit property offences. As per their plan, on 12.06.2015 A.1 to A.4 came to Mahaboobnagar, broke open the lock of the house of the informant at Laxminagar Colony and committed theft of gold ornaments weighing 8.8 tulas. Out of said gold, 38 grams of gold was given to A.2 and remaining gold was taken by A.1, A.3 and A.4. On arrest of the accused in another crime, the Police recovered 50 grams of gold from A.3 and 32 grams of gold from A.2 relating to present crime. Hence, the case.

Heard the learned counsel for the petitioner as well as the learned Public Prosecutor.

Learned counsel for the petitioner submits that the petitioner is innocent of the offence alleged and she has been falsely implicated in the crime. The same is strongly opposed by

the learned Public Prosecutor contending that the petitioner is involved in twelve more crimes.

Having regard to the nature of allegations made against the petitioner and as the material on record discloses that the petitioner is involved in 12 similar offences, I am not inclined to consider the request of the petitioner. However, it is always open to the petitioner to surrender before the concerned Court and move an application seeking regular bail, in which event the same shall be dealt with in accordance with law, at the earliest.
