This writ petition is filed to declare the action of the 3rd respondent in interfering with the peaceful possession and enjoyment of land to an extent of Ac.0-06 cents in sy.No.7/12B situated at Puttur village and mandal, Chittoor district without issuing any notice to the petitioner.
Learned counsel for the petitioner submits that though the subject land is allotted to the petitioner-association and the 3rd respondent issued proceedings dated 24-02-2009 by handing over possession and though the name of the petitioner-association was mutated in revenue records, the respondents are trying to evict the petitioner from the subject property.
Learned Assistant Government Pleader for Revenue says that they will follow due process of law when respondents want to evict the petitioner from the subject property. In the view of the same, writ petition is disposed of directing the respondents not to evict the petitioner from the subject property without following due process of law. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
