THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25781 of 2015 ORDER:

The petitioner states that a notification was issued by the second respondent for appointment of fair price shop dealer for shop No.1, Tripurapuram Village, Nuzendla Mandal, Guntur District. Pursuant to the said notification, three individuals applied for dealership under OC category and the petitioner was one among them. A written test was held on 08.01.2012 and an oral interview was conducted on 21.07.2012. The fifth respondent was appointed as a dealer. Challenging the appointment of the fifth respondent, the petitioner preferred an appeal before the fourth respondent and when the appeal was not disposed of for a long time since 27.07.2013, the present Writ Petition was filed. In view of the pendency of the appeal before the fourth respondent, this Court is not inclined to go into the merits of the case.

Since the appeal was filed way back on 27.07.2013 challenging the appointment of the fifth respondent, this Writ Petition is disposed of directing the fourth respondent to consider the appeal preferred by the petitioner by giving due opportunity to the petitioner and the fifth respondent, and pass final orders after conducting enquiry, within a period of three months from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
