HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.36018 OF 2017 ORDER:

The petitioner is the owner of Bolero Goods Vehicle bearing No.AP 36-TA-7896 and having valid permit to operate the same as Goods vehicle. One Chippa Srinivas, friend of the petitioner has taken the said vehicle and using the same to meet his agricultural use and could not return the same inspite of his requests. The petitioner came to know that on 01-10-2015 the vehicle was seized by the forest authorities on the allegation that said Chippa Srinivas was transporting Teak logs 22 Nos/1.2419 cmt and valued Rs.41,915/- and a case was registered against him under Forest Law in POR No.413/9, dated 01-10-2015. The petitioner made application on 12-09-2017 for release of the vehicle before the 3rd respondent. As no orders are passed on the same, the present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Forest, who seeks time for getting instructions.

It is to be seen that the application is pending before the 3rd respondent, it is for the 3rd respondent to consider the same and pass orders.

In view of the same, the 3rd respondent is directed to consider the application of the petitioner in accordance with law and pass orders accordingly, if not already passed.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
