Heard learned counsel for the petitioner and learned Assistant Government Pleader for Services. It is the case of the petitioner that he was suspended vide proceedings Rc.No.2747/2014/S8, dated 09.07.2014 issued by the 2nd respondent. Aggrieved by the said suspension, petitioner filed O.A.No.4404 of 2014 before the Andhra Pradesh Administrative Tribunal and same was disposed of vide judgment dated 11.12.2014 with a direction to the respondents to regularize the suspension period of the petitioner depending upon the result of the proposed disciplinary enquiry which is sought to be conducted against the petitioner. It is also observed therein that in case they fail to initiate any enquiry and complete it within a reasonable period, the petitioner would be at liberty to make a representation to the respondents to regularize the suspension period as on duty and the respondents shall consider the same and pass appropriate orders.
Subsequently, the petitioner was reinstated into service vide proceedings Rc.No.26/2014/T, dated 24.10.2014 in view of aforesaid orders in OA. The 2nd respondent-disciplinary authority himself conducted enquiry on 19.09.2016 and
instructed the petitioner to remove the electrical poles. Subsequently, petitioner made representation dated 04.07.2017 stating that all the electrical poles have been removed from the forest area and requested to regularise the suspension period and release the Annual Grade Increments, Special Grade Promotions, by dropping the Disciplinary Action. But no orders are passed on the aforesaid representation. Aggrieved by the same, present writ petition is filed.
Since the disciplinary authority concluded enquiry on 19.09.2016 and the petitioner made representation on 04.07.2017 for regularization of his services during period of suspension, the 2nd respondent is directed to consider the representation of the petitioner and pass appropriate orders, in accordance with law, and take action accordingly. With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stand disposed of.
