Heard.
The petitioner was appointed as a Fair Price Shop Dealer of Shop No.19 of Nethra Palli Village, Gummagatta Mandal, Anantapur District, on permanent basis on compassionate grounds. The licence of the petitioner is valid upto 31-03-2016. The petitioner was supplied stocks till March, 2015 and thereafter, it was stopped for unexplained reasons. The petitioner has approached the 2nd respondent seeking his intervention for supply of the stock by the 3rd respondent in order to distribute the same to the cardholders. The 2nd respondent vide his letter L.Dis.No.K6/477/2015, dated 06-06-2015 directed the 3rd respondent to take action as per APSPDS (Control) Order, 2008. As the same is not implemented, the present writ petition is filed.
The 3rd respondent should have seen that as long as the authorisation of the petitioner is in force, the petitioner is entitled for the stock for onward distribution to the cardholders. As per the averments made in the affidavit and the submission made by the learned counsel for the petitioner, no proceedings were initiated against the petitioner. In the circumstances, one has to assume that the authorisation of the petitioner is in force as on today.
In view of the same, this writ petition is disposed of directing the 3rd respondent to release the stock of the petitioner so long as the authorisation of the petitioner is in force.
