HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42264 OF 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the 3rd respondent in disposing of the Inams Case as illegal and arbitrary.
Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents 1 to 3. With their consent, the writ petition is disposed of at the stage of admission itself. There is no necessity to put respondent No.4 on notice, since this Court is not venturing to adjudicate the case on merits.
As seen from the record, as against the endorsement of the 3rd respondent in Rc.C.262/2013 dated 20.04.2013, R.4 herein filed an appeal before the Revenue Divisional Officer, Kavali, on 08.05.2013. Vide order dated 15.06.2013, the RDO while setting aside the endorsement dated 20.04.2013, directed the Tahasildar to conduct enquiry in tune with the orders of Commissioner of Appeals in proceedings Nos.VI/732, 733, 734/2005 and VI/47/2006 dated 19.01.2009. It is the grievance of the petitioner herein that in spite of issuing Form-I notice on 23.06.2015, the Tahasildar has not disposed of the Inams case till date. Learned AGP would submit that a suitable direction may be given to the 3rd respondent to dispose of the Inams case, if the same is still pending consideration, in accordance with law.
Having considered the rival submissions made, the writ petition is disposed of directing the 3rd respondent-Tahasildar, Jagadarthi Mandal, SPSR Nellore District, to dispose of the Inams case as directed by the Revenue Divisional Officer vide order dated 15.06.2013, in accordance with law, after hearing the petitioner and other aggrieved persons, if any including respondent No.4, as early as possible, preferably within a period of three months from the date of receipt of a copy of this order.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
