HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.5624 OF 2015 O R D E R :

The grievance of the petitioners is that though they were granted pattas in respect of land in Survey No.30 to an extent of 75 Sq.yards, the 2nd respondentGuntur Municipal Corporation issued the impugned notice dated 27.02.2015 for their eviction. The petitioners earlier filed W.P.No.2436 of 2014 and this Court disposed of the same directing the 2nd respondent to take action in accordance with law after giving notice to the petitioners and an opportunity of being heard them. A perusal of the impugned notice shows that the petitioners have illegally occupied part of land of Municipality's park/school/play ground in Survey No.44/A and made illegal construction therein, in violation of the judgment of the Supreme Court in S.C.Nos.1902 and 577 and orders of this Court in W.P.Nos.26276 of 1996 and 15188 of 2006 and also G.O.Ms.No.

72 MA dated 20.02.2002, and therefore, they are directed to remove the illegal constructions. The order passed by this Court in W.P.No.2436 of 2014 pertains to Survey No.30 and the pattas produced by the petitioners also shows the same survey number. But the impugned notice relates to Survey No.44/A. Further, the petitioners occupied the said land of Municipality, illegally in violation of the judgment of the Supreme Court in S.C.Nos.1902 and 577 and orders of this Court in W.P.Nos.26276 of 1996 and 15188 of 2006 and also G.O.Ms.No.72 MA dated 20.02.2002. In view of the same, I do not see any merit in the writ petition. Accordingly, the writ petition is dismissed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
