HON'BLE SRI JUSTICE R.SUBHASH REDDY CIVIL REVISION PETITION No.2870 of 2015 ORDER :

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed by the petitioner/respondent No.1 in Transfer O.P.No.627 of 2015, questioning the maintainability of the said Transfer O.P. pending on the file of the Chief Judge, City Civil Court, Hyderabad.

2. Heard learned counsel for the petitioner and perused the material on record.

3. Respondent Nos.1 and 2 herein have filed aforesaid Transfer O.P.No.627 of 2015 on the file of the Chief Judge, City Civil Court, Hyderabad, seeking to transfer E.P.No.10 of 2014 on the file of the III Additional Chief Judge, City Civil Court, Hyderabad, to the Court of XII Additional Chief Judge, for disposal along with I.A.No.124 of 2014 in O.S.No.403 of 2009 or to transfer I.A.No.124 of 2014 in O.S.No.403 of 2009 from the Court of XII Additional Chief Judge, to the Court of III Additional Chief Judge, City Civil Court, Hyderabad. They also filed I.A.No.1271 of 2015 in Transfer O.P.No.627 of 2015 seeking stay of all further proceedings in I.A.No.124 of 2014 in O.S.No.403 of 2009 on the file of the XII Additional

Chief Judge, City Civil Court, Hyderabad, till disposal of the aforesaid transfer O.P.

4. Admittedly, no orders are passed in the aforesaid Transfer O.P.No.627 of 2015 or in I.A.No.1271 of 2015. It is fairly conceded by the learned counsel for petitioner that respondent Nos.2 and 3 in the said transfer O.P. are not yet served. Since the aforesaid transfer O.P. is filed only on 9.4.2015, the same has to be considered only after service of notice on respondent Nos.2 and 3 therein.

For the aforesaid reasons, I deem it appropriate to direct the Court below to dispose of the Transfer O.P.No.627 of 2015 as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order. The petitioner is also granted liberty to obtain appropriate orders from the Court below to serve notice on respondent Nos.2 and 3 in the aforesaid Transfer O.P.

6. Subject to the above directions, this civil revision petition is disposed of, at the admission stage. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
