THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5514 of 2016 ORDER:

This Criminal Petition is filed by the petitioners-A.3 to A.10 under Section 482 Cr.P.C., to quash the proceedings in C.C.No.437 of 2009 pending on the file of III Additional Chief Metropolitan Magistrate, Visakhapatnam at Gajuwaka for the offence under Section 420 IPC. Heard.

As seen from the record, a charge sheet arising out of Crime No.84 of 2005 was filed in C.C.No.437 of 2009 by the investigating officer only against A.1 and A.2 and these petitioners were shown as absconding. It is mentioned in the charge sheet that a separate charge sheet will be filed as against these petitioners after their apprehension. Prima facie there are some allegations as against the petitioners and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation and this Court is not inclined to quash the proceedings in the said crime at the threshold. Learned counsel for the petitioners submitted that in view of the pendency of the above crime, the petitioners apprehend arrest and also harassment in the hands of the police.

In view of the above, the police concerned are directed to complete the investigation into the crime without arresting the petitioners herein and file a final report, if any, in accordance with law. The petitioners are directed to appear before the investigating agency and each of them shall execute a personal bond for a sum of Rs.5,000/- with one surety for the likesum to the satisfaction of concerned S.H.O. for their future appearance in connection with the investigation.

Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
