THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.38472 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: " ...to pass an order, direction or writ more particularly one in the nature of writ of mandamus declaring the action of official Respondents in not considering the Representation, dated 26.10.2017 submitted by the petitioner Association wherein it requested it to stop the illegal construction over the premises bearing No.1-2-605/2/1, admeasuring 400 sq. yards in Sy.Nos.22 & 24 (Old Sy.No.19/2), situated at Daira Village, Kavadiguda, Lower Tank Bund, Hyderabad thereby to demolish the structures of Respondent No.4 as it being illegal, arbitrary and in violation of provisions of GHMC Act and consequently direct the official Respondents to demolish the illegal constructions made by the Respondent No.4 over the above said property thereby to stop the further construction over it and pass such other and further orders which this Hon'ble court deems fit and proper in the circumstances of the case and in the interests of justice."

Heard learned counsel appearing for the petitioner; learned Government Pleader for Municipal Administration & Urban Development appearing for the 1st respondent; and Sri Sampath Prabhakar Reddy, learned Standing Counsel appearing for respondents 2 and 3. I have perused the material record.

At the hearing, learned counsel appearing for the petitioner would submit that if the representation, dated 26.10.2017, is considered by the authority concerned, the grievance of the petitioner would be redressed.

Learned Standing Counsel appearing for the respondents 2 and 3 endorses the said submission.

Recording the said submission, the Writ Petition is disposed of directing the 3rd respondent to consider and dispose of the representation, dated 26.10.2017, within four weeks from the date of the receipt of a copy of this order, in strict accordance with the procedure established by law and communicate the decision taken thereon to the petitioner within one week after taking such decision. There shall be no order as to costs.
