HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38935 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 2nd respondent in not disposing of the representations dated 25.3.2017 and 9.4.2018, submitted by the petitioners questioning the action of the 2nd respondent for illegally incorporating the name of the 3rd respondent without issuing any notice to the petitioner No.2 who is the absolute owner of the house bearing No.1-4-63, Kannalabasthi, Bellampally, Mancherial District, as illegal and arbitrary. Learned counsel for the petitioner submits that though the petitioners submitted representations on 25.3.2017 and 9.4.2018, to the 2nd respondent, seeking to correct the Municipal records by deleting the name of the 3rd respondent and mutate the name of 2nd petitioner-Yerra Samba Rajam, for the subject house, no action has been taken so far. Smt P. Lakshmi, learned Standing Counsel for the Warangal Municipality, would submit that a direction may be given to the 2nd respondent, to pass appropriate orders, on the representation of the petitioner, in accordance with law.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondents, to deal with the representation dated 09.04.2018, submitted by the petitioners seeking to correct the Municipal records, by deleting the name of the 3rd respondent and mutate the name of 2nd petitioner-Yerra Samba Rajam, for the subject house, and pass appropriate orders, in accordance with law as early as possible, preferably within a period of two to three months from the date of receipt of copy of this order, by giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.
As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
