THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition Nos.38141,38146,38148,38149,38157 & 38164 of 2017 COMMON ORDER:

These writ petitions are filed seeking more or less the same relief. The common complaint in these writ petitions is that the respondents are proceeding to demolish the properties of the petitioners, inter alia, alleging that the petitioners erected the structures on tank beds/ nalas and that such structures are obstructing flow of rain water and that due to such structures large scale inundation of parts of Hyderabad City has occasioned in the recent past when there were heavy rains and that the writ petitioners in W.P.Nos.38141,38146,38148,38157 & 38164 of 2017 were asked to remove the structures by invoking Section 406 of Hyderabad Municipal Corporation Act, 1955, while the petitioner in W.P.No.38149 of 2017 was asked to remove the structures even without issuing a notice.

The writ petitioners in all the writ petitions submit that there is an immediate threat of demolition of structures of the petitioners which are in existence since a long time. At the hearing, learned counsel for the petitioners, learned standing counsel appearing for the respondents 2 & 3 and the learned Government Pleader representing the 1st respondent fairly stated that the issue involved in the present batch of writ petitions is squarely covered by interim order, dated 30.09.2016, of this Court in WPMP.No.42127 of 2016 and batch in WP.No.34149 of 2016 and batch and that if these writ petitions are also disposed of in terms of the said interim order, the grievance of the writ petitioners would stand redressed.

Having regard to the facts and submissions and for reasons alike as were mentioned in the afore-stated interim order of this Court, these writ petitions are disposed of in terms of the said interim order.

Office is directed to enclose a copy of the aforesaid order, dated 30.09.2016, passed in WPMP.No.42127 of 2016 and batch in WP.No.34149 of 2016 and batch to this order.
