THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition Nos.38156, 38160, 38168, 38173 and 38233 of 2017 ORDER:

These writ petitions are filed seeking more or less a common relief, inter alia, alleging that the respondents 2 to 5 are digging subject lands of the petitioners for the purpose of laying a Nala even without acquiring the lands and even without a prior notice.

At the hearing, learned counsel for the petitioners would submit that if the respondents 2 to 5 follow the procedure established by law before taking any coercive action in respect of the properties of the petitioners, the grievance of the petitioners stands redressed.

Learned standing counsel representing the respondents 2 to 5 would submit that the respondents 2 to 5 would follow the procedure established by law and if necessary initiate acquisition proceedings before any work of Nala is undertaken in the lands of the petitioners herein.

Recording the afore-said submissions, all the Writ Petitions are disposed of directing the respondents 2 to 5 not to interfere with the subject lands of the petitioners herein in any manner except in strict accordance with the procedure established by law.

There shall be no order as to costs.
