THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.38483 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking verbatim the following relief: " ...to issue writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 4th & 5th respondents in not acting pursuant to the complaints/representations made by the petitioner against the illegal, unauthorised construction made by the 6th respondent, adjacent to my house duly encroaching public road as illegal, arbitrary, unjust and unreasonable and contrary to Article 14 of the Constitution of India and consequently direct 4th & 5th respondents to stop the construction made without the permission of the GHMC, i.e., 4th respondent and further demolish the pillars made by the 6th respondent towards the constructions made and pass such other order or orders may deem fit and proper in the circumstances of the case, and to pass such other order or orders as this Hon'ble Court may deems fit, just and proper in the circumstances of the case." 2.

Heard learned counsel appearing for the petitioners; learned Government Pleader for Municipal Administration & Urban Development appearing for the 1st respondent; and Sri Chatla Madhu, learned Standing Counsel appearing for respondents 2 to 5. I have perused the material record.

At the hearing, learned counsel appearing for the petitioners would submit that if the representation, dated 13.09.2017, is considered and disposed of by the 5th respondent, the grievance of the petitioners would be redressed.

Learned Standing Counsel appearing for the respondents 2 to 5 endorses the said submission.

Recording the said submission, the Writ Petition is disposed of directing the 5th respondent to consider and dispose of the representation, dated 13.09.2017, of the petitioner within four weeks from the date of the receipt of a copy of this order, in strict accordance with the procedure established by law and communicate the decision taken thereon to the petitioners within one week after taking such decision.

There shall be no order as to costs.
