The petitioner seeks a Mandamus declaring the action of the respondents in not demolishing the bathroom constructed by the 4th respondent in balcony place of his Flat No.202 as illegal, arbitrary and in violation of the provisions of law.

I have heard the submissions of Sri C. Subodh, learned counsel for the petitioner, and of Sri N. Ashok Kumar, learned standing counsel representing the respondents 2 & 3. I have perused the material record.

The grievance of the petitioner is that the above stated bathroom constructed in the balcony of Flat No.202 of the 4th respondent is right above the balcony of the petitioner and that the pipelines of that bathroom are passing by the side of the bedroom of the petitioner and that, therefore, the same are causing nuisance to the petitioner and that despite a complaint to the respondents, no action has been taken by them. Learned standing counsel would submit that the respondents would consider and dispose of the representation of the petitioner in accordance with the procedure established by law. Recording the submissions, the Writ Petition is disposed of directing the 3rd respondent to consider and dispose of the representation, dated 06.11.2017, of the petitioner within a period of four (04) weeks from the date of receipt of a copy of this order in

strict accordance with the procedure established by law and communicate the decision taken thereon to the petitioner within a week thereafter.

There shall be no order as to costs.
