THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34433 of 2017 ORDER:
Heard Sri Karri Murali Krishna, learned counsel for the petitioner, Sri Sampath Prabhakar Reddy, learned Standing Counsel appearing for respondent Nos. 2 and 5 and the learned Government Pleader appearing for R1, R3 and R4. When the matter is called, it is submitted by the learned counsel for the petitioner so also the learned Standing Counsel appearing for R2 and R5 that the issue involved in the present Petition is squarely covered by the order of this Court in W.P.No.6195 of 2017, dated 22.02.2017 and placed on record a copy of the same along with Writ Petition material papers. The operative portion of the said order reads as under:
"following the above said Orders, this Writ Petition is also disposed of directing respondent Nos. 2 and 5 to consider the application of the petitioner for grant of building permission in the subject land, within a period of eight weeks from the date of receipt of a copy of this Order, subject to the condition that the petitioner satisfies the requirements under Section 28 of the Greater Hyderabad Municipal Corporation Act, 1955 and also subject to her giving an undertaking that she would not claim any equities or costs spent on the construction, in the event LGC is decided against her, without reference to the Letter dt. 31.10.2013 of the Zonal Commissioner, GHMC, Hyderabad. No costs".
Following the aforesaid order and for the reasons recorded therein, this Writ Petition is also disposed of on the same lines to that of W.P.No.6195 of 2017.
Office is directed to enclose a copy of the order in W.P.No.6195 of 2017 to this order.
As a sequel thereto, the miscellaneous petitions, if any, pending shall stand closed.
