This Criminal Petition is filed under section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short' BNSS') seeking the Court to enlarge the petitioners on bail who are arrayed as accused Nos.1 and 2 in Crime No.758 of 2025 of Nacharam Police Station, Medchal-Malkajgiri District, registered for the offences punishable under Section 8(c) read with 15(b) of NDPS Act.

The brief facts of the case are that, on 12.12.2025 the complainant while conducting vehicle check at Nacharam Cross roads along with his team they noticed two persons proceeding on a black color Bajaj Pulsor bike bearing No.TG08S 8919 and on checking the police found them in possession of 14.7 kgs of poppy straw in their cement bag. Hence, the same was seized from their possession and complaint was lodged basing on which, case was registered against the accused for the above offences.

Heard Sri P.Manoj Kumar, learned counsel for petitioners and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for respondent - State.

The contention of learned counsel for the petitioners is that petitioners are innocent of the said allegations and they are falsely implicated in this case. The petitioners are in jail from 12.12.2025 and the seized contraband is 14.7 kgs which is intermediate quantity. As such, prayed this Court to grant regular bail to the petitioners.

On the other hand, the learned Additional Public Prosecutor opposed bail stating that it is a NDPS case therefore, petitioners are not entitled for bail. However, he informed that there are no other cases pending against the petitioners. Hence, prayed this Court to dismiss the criminal petition.

Considering the submissions made by both the counsel and material on record, petitioners are in jail from 12.12.2025 and the seized contraband is 14.7 kgs which is an intermediate quantity and no other cases are pending against the petitioners. Considering the period of incarceration of petitioners in jail and also the quantum of contraband, this Court deems it appropriate to grant bail to the petitioners subject to the following conditions.
i. The petitioners/A.1 & A.2 shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each with two sureties for a like sum each to the satisfaction of the IAdditional District & Sessions Judge, MedchalMalkajgiri District at Kushaiguda. ii. The petitioners/A.1 & A.2 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii. The petitioners/A.1 & A.2 shall abide by the conditions stipulated in Section 483(2) of the BNSS.
