HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.39968 of 2018 ORDER:

Aggrieved by the inaction on the part of the 4th respondent in mutating the name of the petitioner having received the representations dated 22.12.2017, 04.04.2018, 26.05.2018, 04.06.2018 and Form No.VIA dated 17.09.2018 under Rights in Land and Pattadar Pass Book Act in respect of the land in Sy.No.39/A admeasuring Acs.11.25 guntas, situated at Karamungi Village, Nagalagidda Mandal, Sanga Reddy, erstwhile Medak District, this Writ Petition is filed.

It is the case of the petitioner that her husband late Khamaruddin was the owner, pattadar and possessor of the agricultural land in sy.No.39/A admeasuring Acs.11.25 guntas situated at Karamungi Village, Nagilgidda Mandal, erstwhile Medak District, now at Sanga Reddy District, who got the same through his ancestors, which is evident from the Pattadar Pass Book and Title Deed; that the husband of the petitioner is resident of Bidar and her son is also the employee of Police Department at Bidar, as such, she is residing at Bidar, Karnataka State; that till the death of the husband of the petitioner, during his life time, he used to cultivate the land through agricultural labor till his death; that the husband of the petitioner died on 29.05.2013 and thereafter the petitioner along with her son are cultivating the land with the help of agricultural labour and is continuing the same, though they are residing at Bidar; that after the death of

the husband of the petitioner, the petitioner and her son succeeded the subject property and made representation on 22.12.2017 for mutation of their names in the revenue records. Though the petitioner made several representations, the 4th respondent is not considering the same. Aggrieved by the same, present Writ Petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

The only grievance of the petitioner is that though she made several representations before the 4th respondent for mutation of her name in revenue records, the same is not being considered and disposed of.

In view of the same, since representations filed by the petitioners are stated to be pending before the 4th respondent, without expressing any opinion on the merits of the case, the 4th respondent is directed to consider the same, in accordance with law and take action, after issuing notice to the affected parties, within a period of three months from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. ___________________________ A.RAJASHEKER REDDY,J 06.11.2018 kvs
