HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8599 of 2016 ORDER:

The petitioner challenges the order dated 4.3.2016 passed by the second respondent in exercise of powers under Section 128(2) of the Andhra Pradesh Panchayat Raj Act in the appeal preferred against the order dated 2.12.2002 passed by the third respondent rejecting renewal of residential house permission..

The findings given by the appellate authority in the impugned order are that the petitioner has produced the same registered documents for both files of the years 1994 and 2012 for obtaining construction permission and thereby misleading the Gram Panchayat in the process of making construction. In the light of the detailed order passed by the District Panchayat Officer, the petitioner can as well seek remedy as provided

under Section 264 of the AP Panchayat Raj Act which contemplates review or revision of the orders passed by the District Panchayat Officer/Gram Panchayat either suo motu or on application.

In the circumstances, the Writ Petition is closed giving liberty to the petitioner to approach the Government seeking revision/review of the impugned order as provided under Section 264 of the AP Panchayat Raj Act.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
