THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.39009 of 2018 ORDER:

When the matter is taken up, written instructions dated 12.11.2018 furnished by the Sub Inspector of Police, Peddakakani Police Station, Guntur District, are placed on record by the learned Government Pleader for Home.

To the extent of their relevance to the present writ petition, the said instructions read as under:

"It is submitted that as per the writ averment the petitioner filed Insolvency Petition vide I.P.No.14/2016 before the Hon'ble I Senior Civil Judge, Guntur against one Doguparthy Anajaneyulu and others.

It is submitted that the petitioner contended that the respondent No.4 Station House Officer, Peddakakani Police Station, Guntur District and staff interfered with the petitioner life and liberty and called and detained him in the Police station and threatened to get settle the money dispute with the respondent No.5 Smt. T.Lakshmi Kumari is incorrect and baseless. It is submitted that the respondent No.4 and staff did not interfere with the life and liberty of the petitioner at any point of time as alleged by the petitioner herein. As of now, no criminal case is pending against the petitioner herein on the file of the 4th respondent police station, hence the question of calling him to the Police Station does not arise.

It is submitted that the petitioner contended that the 5th respondent lodged a complaint with the 4th respondent against the petitioner and accordingly the petitioner approached the 4th respondent is incorrect and baseless. As per the station records, as of now, no complaint was received from the 5th respondent against the petitioner herein.

It is incorrect to say that the 4th respondent called the petitioner to the Police Station and detained him on 26.10.2018 and 27.09.2018 and directed to get the matter settled with the respondent No.5, hence denied."

On noticing the above instructions, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.

Accordingly, the writ petition is disposed of by placing on record the written instructions dated 12.11.2018 furnished by the Sub Inspector of Police, Peddakakani Police Station, Guntur District. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
