THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.31280 of 2016 ORDER:

The petitioner states that he is working as Superintendent in the respondent No.4 Temple. He was entrusted with the job of supervision of cash book, establishment of money value, gold and silver registers, supervision of closing book, temples and the hours of work was from 2.00 PM to 8.00 PM, but the petitioner was prevented from discharging the duties. No charge was handed over by Smt. Hymavathi, even though the petitioner was asked to take charge from her by proceedings dated 09.12.2015. On the basis of news item published in the 'Mana Telangana' daily on 09.03.2016 in respect of the allegations against respondent No.3 and other persons working in the respondent No.4 temple, respondent No.2 appointed the Regional Joint Commissioner, Endowments Department, Hyderabad to enquire into the allegations.

The Regional Joint Commissioner personally visited the respondent No.4 Temple and made enquiry. She submitted a report on 12.05.2016 to respondent No.2 pointing out various lapses on the part of respondent No.3. The petitioner was called upon to submit his explanation by respondent No.3 by proceedings dated 01.07.2016 and the petitioner submitted his explanation on 06.07.2016.

After receiving the explanation, the petitioner was placed under suspension by

ARLR, J W.P. No.31280 of 2016 proceedings dated 14.07.2016 pending enquiry into the alleged irregularities committed by the petitioner.

Challenging the same, the present writ petition was filed. When the matter is taken up for consideration, it is brought to the notice of this Court by the learned Standing Counsel for respondent No.4 and the petitioner himself stated in Paragraph No.10 of the affidavit that he filed an appeal before respondent No.2 and the same is pending consideration before respondent No.2.

In view of pendency of the appeal before respondent No.2, this Court is not inclined to entertain the present writ petition, but directs respondent No.2 to consider the appeal, preferred by the petitioner on 19.08.2016, within a period of two (2) weeks from the date of receipt of a copy of this order and pass appropriate orders in accordance with law. Accordingly, this Writ Petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
