THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11455 OF 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.2, for grant of bail in P.R.C.No.17 of 2011 of Bhavani Nagar Police Station, Hyderabad, registered for the offences punishable under Sections 120B, 323 and 302 read with 34 of IPC.

Heard the learned counsel for the petitioner/A.2 and the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

It is brought to the notice of this Court that the petitioner/A.2 had filed an application under Section 438 Cr.P.C. and the same was allowed by this Court vide order dated 28.02.2018 in Crl.P.No.2189 of 2018. He was called upon to execute for a bond of Rs.20,000/- with two sureties for a like sum each to the satisfaction of the Court below. Though he was granted bail under Section 438 Cr.P.C. on 28.02.2018 even after the lapse of so many months, he could not furnish the sureties and complied with the conditions mentioned therein. Under these circumstances, the petitioner is not entitled to seek relief repeatedly under Section 438 Cr.P.C. There are no circumstances either to extend the time to furnish the sureties or to allow the petition. The petition is devoid of merit and is liable to be dismissed.

In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
