HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5036 of 2016 ORDER:

Heard Sri K.Narsi Reddy, learned Counsel appearing for the petitioner and Smt. J.Koteswari Devi, learned Standing Counsel appearing for the respondents.

The provisional assessment order dated 20.01.2016 issued by the fourth respondent is challenged before this Court, whereunder and whereby alleging certain malpractices, the petitioner was assessed to Rs.3,21,207 in addition to compounding fee of Rs.22,000/-. It is stated that the petitioner has already paid the compounding fee of Rs.22,000/-.

As against the provisional assessment order passed on account of allegation of theft of power, the general terms and conditions of supply provides for appeal remedy before the designated officer.

In that view of the matter, the consumer/petitioner is at liberty to pay 50% of the amount in

demand to get restoration of power supply subject to final orders that may be passed. Further, the petitioner is given liberty to avail appeal remedy as provided under the terms and conditions of supply, if so advised.

Subject to the above, the Writ Petition is disposed of at the admission stage. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
