HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.6477 of 2018 ORDER:
Aggrieved by the dismissal of an application for reopening the evidence on the side of the defendant, the 1st defendant in the suit has come up with the above writ petition.
2. Heard Mrs. Bonthu Rajani, learned counsel for the petitioner.
3. It is a partition suit. Two witnesses have already been examined on the side of the defendants. In fact, the petitioner examined himself as DW.1.
4. After four months of the evidence getting closed, the petitioner filed an application for adducing more oral evidence. The same was dismissed by the trial Court.
5. I find no illegality or irregularity in the order of the trial Court. This is for the reason that the affidavit filed in support of the application for reopening, does not disclose any reason whatsoever, for seeking the reopening of the evidence. Hence, the dismissal of the application cannot be found fault with.
Therefore, the Civil Revision Petition is dismissed. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
