THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3208 of 2015 ORDER:

1. This Criminal Revision Case is filed by the petitioner aggrieved by the docket order dated 23.11.2015 passed in Crl.M.P.No.4786 of 2015 in Crime No.169 of 2015 by the Judicial First Class Magistrate, Narsapur, West Godavari District.

2. The petitioner-3rd party filed the above Crl.M.P. under Section 457 Cr.P.C. seeking delivery of the case property i.e., MRF tyres bearing Nos.15275-D, 15277-D along with red colour disc wheels bearing Nos.A 6910 WC, DH and SSWL 86131 Xag and Exide battery bearing No.12261 for interim custody.

The learned Magistrate dismissed the said petition. Aggrieved by the same, the petitioner filed this revision.

3. Heard and perused the material available on record.

4. It is the case of the petitioner that the de facto complainant in the above crime is her father and he took her tractor for agricultural works and he kept the same in his fields and some unknown persons committed theft of two MRF company types along with red coloured disc wheels.

5. Considering the above facts and circumstances of the case and since the property in question is in the custody of the police, this Court is inclined to pass the following order:

"The learned Judicial First Class Magistrate, Narsapur, is directed to order for return of the above property to the petitioner herein, on condition of the petitioner executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one

surety for the like sum to the satisfaction of the Judicial First Class Magistrate, Narsapur.."

6. Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions pending, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO Dated: 21.12.2015 Nn
