HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.37866 of 2017 Order:

The petitioner is working as Municipal Manager category-II (presently working as Municipal Commissioner, Grade-III, Sadashivpet Municipality, Sanga Reddy District on Own Pay basis). Departmental proceedings were initiated against the petitioner in the month of January 2016 and the enquiry is not yet commenced. It is the case of the petitioner that his case is not considered for promotion even though he is eligible, only on the basis of pendency of departmental proceedings against him. Learned counsel for the petitioner submits that his juniors were promoted in the meanwhile.

In the circumstances, the Writ Petition is disposed of directing the respondents to consider the case of the petitioner for promotion, if he is otherwise eligible and if there is no rule prohibiting his consideration because of pendency of departmental proceedings. However, the departmental proceedings shall be continued and disposed of as expeditiously as possible and this order will not prevent from proceeding with the departmental proceedings. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
