THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.36852 of 2017 ORDER:
In this writ petition, the submission of the petitioner is that he is the absolute owner of the subject property, which is a residential plot admeasuring 220 Square Yards at SIET Employee Co-operative Housing Society, Guttala Begumpet village, Serilingampally Mandal, Ranga Reddy District, having purchased the same under a registered document bearing No.13112 of 2015 and that his vendor purchased the same under a registered sale deed bearing document no.11767 of 1990 and that the petitioner being an employee working elsewhere, he erected a temporary shed in the property for keeping somebody in the said structure to keep watch over the property and that suddenly there is a threat of demolition from the 3rd respondent and, therefore, the present writ petition is filed.
Learned standing counsel representing the respondents 2 & 3 would submit that admittedly the construction is made without obtaining necessary permission from the GHMC and that the GHMC would take appropriate procedural steps in the matter.
Having regard to the submissions, the Writ Petition is disposed of directing the respondents 2 & 3 not to demolish or take coercive action against the subject property of the petitioner until the said respondents initiate and take appropriate action in strict accordance with the procedure established by law. It is made clear that under the guise of this order, the petitioner shall not make any further constructions in the property and shall maintain absolute status quo as on today. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. __________________ M.Seetharama Murti, J 02.11.2017 Vjl
