These three Writ Petitions are being disposed of by this common order as the cases of the petitioners herein are not being considered for promotion merely due to pendency of departmental proceedings against them.
The petitioner in W.P.No.37696 of 2017 is working as the Manager Category-III in Gajwel Pragnapur Nagar Panchayat, Siddipet District. The petitioner in W.P.No.37714 of 2017 is working as the Sanitary Inspector (presently working as Municipal Commissioner, Nirmal Municipality, on OD basis), and the petitioner in W.P.No.37716 of 2017 is also working as the Sanitary Inspector (presently working as Municipal Commissioner Grade III in Bhainsa Municipality on OD basis). Departmental proceedings were initiated against the petitioners and they are at different stages of enquiry. It is the case of the petitioners that their cases are not considered for promotion even though they are eligible, only on the basis of pendency of departmental proceedings against them. Learned Counsel for the petitioners submits that their juniors were promoted in the meanwhile.
In the circumstances, these Writ Petitions are disposed of directing the respondents to consider the cases of the
petitioners for promotion, if they are otherwise eligible and if there is no rule prohibiting their consideration because of pendency of departmental proceedings.
