THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.35032 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking verbatim the following relief: "I submit that for the Reasons stated above ,it is prayed that this Hon'ble court may be pleased to issue a Writ ,order or Direction more particularly one in the nature of Writ of Mandamus with a direction to the Respondents no 1 to 7 to stop the respondent no 8 and 9 from encroaching the public Road and pass such other orders or Orders the Hon'ble court deems fit and proper in the circumstances of the case and in the interest of Justice." 2.

I have heard the submissions of Sri K.W.J. Bose, learned counsel appearing for the petitioners, the learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent, and of Sri Sampath Prabhakar Reddy, learned Standing Counsel for the Greater Hyderabad Municipal Corporation (GHMC), appearing for the respondents 2 to 6. I have perused the material record.

At the hearing, learned counsel for the petitioners would submit that a representation, dated 25.06.2017, was already given by two plot owners complaining against the gate erected on the Public Road and that despite such representation, no action has been taken and that this writ petition may be disposed of with appropriate directions. 4.

Learned Standing Counsel appearing for the respondents 2 to 6 endorses the said submissions.

Having regard to the submissions, the Writ Petition is disposed of reserving liberty to the petitioners to submit a representation to the Commissioner, GHMC, Hyderabad (2nd respondent), within a week from the date of receipt of a copy of this order stating their grievance

MSRM, J W.P.No.35032 of 2017 and reasons in support of their grievance; on the petitioners submitting such a representation, the authority concerned of the GHMC shall consider and dispose of the same within a period of eight

(08) weeks thereafter, however, in strict accordance with procedure established by law and also by affording an opportunity of hearing to the petitioners as well as the respondents 8 & 9, and communicate the decision taken thereon to the petitioners within a week after taking such decision in the matter.
