This Writ Petition was filed seeking to declare the action of the respondents 2 and 3 in not maintaining 60 feet proposed road between Cyber Village and new Cyber Valley Colony at Miyapur starting from Vignan Junior College to Miyapur to Kondapur Highway in Survey No.45P, situated at Miyapur, Ranga Reddy District, Hyderabad, and in not considering the representations dated 13.02.2017 and 18.03.2017 made through whatsapp and the complaints dated 26.04.2017 and 10.05.2017 made through GHMC App and the notice dated 25.09.2017, as illegal and arbitrary and consequently direct the respondents 2 and 3 to demolish the encroached constructions on the 40 feet road starting from Vignan Junior College to Miyapur to Kondapur Highway.
It is submitted by the learned counsel for the petitioner that though in the master plan 60 feet road is provided and the petitioner is insisted to maintain 60 feet while making constructions, now permissions are being granted by maintaining 40 feet and there are unauthorized constructions. He further submitted that the petitioner submitted several complaints bringing to the notice of the third respondent with regard to the encroachments on the road and constructing structures without leaving any set backs way back from February 2017 to May 2017. The petitioner filed copy of the messages sent to the third respondent followed by a legal notice dated 25.09.2017. In the notice it was specifically requested to demolish the constructions in Plot Nos.52 and 242 in Cyber Valley and Plot No.52 in Cyber village.
In view of the same, the third respondent is directed to consider the legal notice dated 25.09.2017 issued on behalf of the petitioner and pass appropriate orders/take action in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
