HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.36443 of 2017 ORDER:

In this writ petition, under Article 226 of the Constitution of India, the grievance of the writ petitioner is in regard to the failure of respondents 1 to 4 to take action against the fifth respondent's unauthorised and illegal constructions, which are affecting easementary rights related to light, air etc., of the property of the petitioner.

The case of the petitioner is that earlier he filed W.P.No.30681 of 2017 and that the said writ petition was disposed of giving liberty to him to make appropriate representation before the respondent authorities for redressal of his grievance and that thereafter, he submitted a representation, on 23.09.2017, but no appropriate remedial action is taken by respondents 1 to 4. 3.

At the hearing, learned counsel for the petitioner would submit that if a direction is given to respondents 1 to 4 to consider and dispose of the aforestated representation of the petitioner, the ends of justice would be met.

Learned Standing Counsel appearing for respondents 2 to 4 endorses the said submission.

Recording the submissions, the writ petition is disposed of directing respondents 1 to 4 to consider and dispose of the representation dated 23.09.2017 of the petitioner within four weeks from the date of receipt of a copy of this order in strict accordance with the procedure established by law and

communicate the decision taken thereon to the petitioner within a week thereafter.
