HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.29962 of 2016 ORDER:

This writ petition is filed seeking a writ of Mandamus declaring the action of the third respondent in not disposing of the representation of the petitioner dated 04.07.2016 as arbitrary and illegal.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue(Andhra Pradesh), representing the respondents 1 and 2 and the learned Assistant Government Pleader for Irrigation and Command Area Development (Andhra Pradesh), representing the respondents 3 and 4. 3.

A perusal of the record reveals that the petitioner was elected as Sarpanch of Seenappagaripalli village, K.V.Palli Mandal, Chittoor District in the year 2013. It is the case of the petitioner that the second respondent has sanctioned the works in favour of the fifth respondent pursuant to the G.O.Ms.No.70, dated 04.12.2014 vide his proceedings No.SE/ IC/ CTR/ DB/ NCP/ 80-R, dated 28.05.2016 in respect of the petitioner's village. A perusal of the record further reveals that the petitioner herein submitted a representation dated 04.07.2016 to the third respondent. 4.

At the time of arguments, the only relief sought by the petitioner's counsel is to direct the third respondent to dispose of the representation of the petitioner dated 04.07.2016. The

learned Assistant Government Pleaders also consented for the same.

Having regard to the facts and circumstances of the case, the third respondent is hereby directed to consider the representation of the petitioner dated 04.07.2016 in accordance with law as expeditiously as possible, preferably within a period of one month from the date of receipt of copy of this order. 6.

With the above direction, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
