THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.36788 of 2017 ORDER:

This writ petition is filed seeking the following relief/ s: '...to issue an appropriate writ order or direction, particularly one in the nature of Writ of Mandamus declaring the action of the respondents No.2 & 3 in trying to demolish and dispossess the petitioner from the house bearing H.No.4-1-16 situated at Pedda Cheruvu Road, Ramaiah Bowli, Mahabubnagar without any authority, without following the procedure as contemplated under the Law as being illegal, arbitrary, unjust and in violation of Article 21 and 300-A of the Constitution of India and to pass such other order or orders..'

At the hearing, learned counsel for the petitioner submits that the facts and issue involved in the present matter are identical to the facts and issue involved in W.P.No.35661 of 2017 and that this Court disposed of the said writ petition by an order, dated 25.10.2017, and that, therefore, this writ petition also may be disposed of by passing an appropriate similar order as was passed in the afore-stated writ petition.

Learned standing counsel representing the respondents 2 & 3, while endorsing the said submission, would further submit that the respondent authorities will issue notices to the petitioner in accordance with the procedure established by law before taking any action.

Recording the afore-said submissions, the Writ Petition is disposed of directing the respondents not to interfere in any manner with the property of the petitioner except after following the procedure established by law. It is made clear that the respondents 2 & 3 are at liberty to initiate action in accordance with the procedure established by law, if they intend so to do. There shall be no order as to costs.
